⚫︎ Bungie's attempt to dismiss a copyright lawsuit was denied after the studio couldn't provide evidence for in-game content that has been moved to the Destiny Content Vault. The lawsuit, brought by writer Matthew Kelsey Martineau, claims that Destiny 2’s Red Legion closely resembles a faction detailed in his writings, published before the game's release.
Bungie argued that the elements cited were different from those in Destiny 2, but the judge ruled that without access to the vaulted content, the company couldn't substantiate its claim. This case underscores the legal challenges of live-service games where content may become inaccessible after updates.

⚫︎ A judge has rejected Bungie's attempt to dismiss a copyright lawsuit by referring to now-unavailable Destiny 2 content. The studio's suggestion to use lengthy YouTube lore videos as evidence was dismissed. The lawsuit, initiated by sci-fi author Matthew Kelsey Martineau in October 2024, alleges that Bungie borrowed key concepts from a story he published under the pseudonym Caspar Cole. Both Martineau's work and Destiny 2’s Red War campaign share similar elements, including the "Red Legion," flamethrowers, and war hounds.
The removal of the campaign into the Destiny Content Vault complicates Bungie’s defense, and the judge declined to review the proposed 10-hour lore videos, highlighting the challenge of preserving evidence in live-service games where content can be made inaccessible over time.
